SETDART ONLINE S.L., with registered office at 346 Aragon Street, Barcelona, and tax identification number B-63637953, through the bases posted below, establishes the rules by which to govern this photography contest.
The SETDART BARCELONA PHOTO CONTEST intends to see the city of Barcelona through the eyes of its visitors. The aim is to analyze how people from other countries see our city and what makes Barcelona the third most photographed city in the world (according to Google and Sightmaps).
The aim is that participants provide their personal and unique view of Barcelona, including any feature they may consider representative of the city.
The contest consists of the publication of photographs on the Facebook group created for this purpose. Twenty-five pictures will be shortlisted and a jury will select a winning photo among them.
The contest begins February 17, 2014 and ends May 19, 2014, 10 p.m. (UCT +1).
Photographs submitted after the deadline will not enter the contest.
3. HOW TO ENTER
Notice and rules for this contest will be announced on the website http://setdart.com, both in English and Spanish. In order to take part in the contest, a Facebook account will be required, as well as complying with the conditions of this network.
- Assign a title to the picture.
- Tag the picture with the at least one of the suggested hashtag/s: #SetdartBarcelona, #SetdartPhotoContest, #Barcelona, #art, notwithstanding any other tags that the author might want to include .
- Post the picture on the Facebook group ‘Setdart Barcelona Photo Contest’ (https://www.facebook.com/groups/setdartbarcelona/).
By submitting an entry, each entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules.
Each participant may submit up to 2 photographs.
Photographs taken prior to the publication of these rules are eligible, provided they meet all conditions of participation.
Setdart may publish on its website http://www.setdart.com/, Facebook page https://www.facebook.com/setdartauction, https://www.facebook.com/setdartsubastas, Twitter page https://twitter.com/setdart and blog http://setdart.org/ any photographs it deems useful to promote competition during the contest. After the contest, Setdart may publish the winning photo, always crediting its author.
4. FEATURES OF PHOTOS
Submitting a picture to the contest implies the confirmation that the photograph:
- Has been taken in the city of Barcelona.
- Has been taken by the contest entrant and is an original work.
- Does not contain references to third-party trademarks.
- Has no obscene, sexually explicit, violent, offensive, inflammatory or defamatory content.
- The participant has obtained the necessary authorizations from the people that may appear in it.
By entering the Contest, entrant acknowledges and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph. The photograph must not contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.
The organizing committee is entitled to reject any photographs that comply with the above features, damage the image of Barcelona, as well as those which discriminate on grounds of birth, race, sex, religion, opinion or any other personal condition.
The prize consists of a two-night stay for two people at a hotel selected by Setdart, in the city of Barcelona. Availability needs to be checked before booking.
The prize is valid for 2014.
Under no circumstances the prize may be exchanged for money.
6. PARTICIPATION TERMS
Contest is open to individuals of legal age who are not involved in the preparation of this contest.
Setdart especially encourages amateurs to participate, since this is not a competition aimed at professional photographers.
Participants assume responsibility for the contents of the proposal and shall be liable to third parties. If the photograph contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation.
- Acceptance of conditions:
Participation in the contest implies full acceptance of all the rules and involves submission to interpretative decisions of the jury.
7. SELECTION PROCESS
Contest consists of two rounds of evaluation. In Round One, photographs will be displayed on the Facebook group created for this purpose, and susceptible of being “liked” and “shared” by any Facebook user. The entries considered most popular will proceed to Round Two. In Round Two, the Judges will collectively select a winner from among the photographs selected in Round One.
- ROUND ONE:
Among all the photographs that meet the eligibility requirements described in these rules, the 10 most popular photos on Facebook will be selected. Popularity criteria to be considered are the number of “likes” and the number of “shares” on the Facebook network.
- ROUND TWO:
The shortlisted photographs will be passed to the jury, who will meet on May 20, 2014. The jury will then select a winning photograph. Starting on May 22, 2014, Setdart will contact the winner through their Facebook profile and by the means available and considered appropriate.
Setdart will instruct the winner to facilitate their name, phone number and mailing address. In the event of failure to contact the author of the winning photograph, a second picture will be chosen.
The jury will be composed by members of Setdart staff and professionals selected for this purpose.
The jury members are:

The judging criteria will be:
• The originality of the image.
• The image’s representativeness of the city of Barcelona.
Decisions made by the jury will be final.
By entering the contest, all entrants grant an irrevocable, perpetual, worldwide non-exclusive license to Setdart, in accordance with current copyright law.
These rights include license for Setdart to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in connection with the contest, in any media now or hereafter known.
10. DATA PRIVACY
Setdart will comply with current legislation regarding the protection of personal data, set by Law 15/1999 and Royal Decree 1720/2007 of 21 December, by which the Regulation Act is approved.
Entrants agree that personal data may be processed and used for the purposes and within the context of the contest. The data may also be used by Setdart in order to share information about new contests and other commercial and promotional information via e-mail or other delivery channels.
Participants have the right to access, review, rectify, or cancel any personal data held by Setdart. Personal data will be used by Setdart exclusively for the purposes stated herein.
In any litigation that might arise from this promotion and the interpretation and application of these rules, both Setdart and the participants expressly waive any privilege that may apply to them, and are subject to the courts and tribunals of the city of Barcelona and the Spanish State law.
